Terms of Service

Effective Date: August 29. 2026

These Terms of Service ("Terms") govern your use of opportunitypointsystems.com, your submission of inquiries to Opportunity Points Systems, and participation in our email and text-messaging programs. Opportunity Points Systems is operated by Pembroke Capital Funding, LLC (collectively, "OPS," "we," "us," or "our"). By using the website, you agree to these Terms.

These website and messaging terms are not a substitute for a separate written client services agreement. If you become an OPS client, the signed client agreement will control the paid services, fees, implementation responsibilities, service levels, and cancellation rights covered by that agreement.

1. Website Purpose

The website provides general information about OPS and allows businesses to request information about our managed lead-response, follow-up, qualification, appointment-coordination, and revenue-enhancement services. Website content is provided for general informational purposes and may be updated without notice.

2. Eligibility and Business Use

You must be at least 18 years old and legally able to enter into agreements to use the website. If you act for a company or other organization, you represent that you are authorized to provide information and communicate on its behalf.

3. Inquiry Submissions

You agree that information submitted through the website will be accurate and that you have authority to provide it. Submitting a form requests contact from OPS but does not create a client relationship, guarantee acceptance, or obligate either party to purchase or provide services.

4. Electronic Communications

When you provide an email address or otherwise communicate electronically, you consent to receive replies and service-related communications electronically. Marketing email may be stopped by using an unsubscribe link or contacting us.

5. SMS/Text Messaging Terms

If you separately opt in, Opportunity Points Systems may send text messages concerning your inquiry, appointment coordination, service information, educational content, announcements, and, where separately authorized, promotional information.

  • Consent is optional and is not a condition of purchasing services or submitting an inquiry.
  • Message frequency varies according to your interactions and preferences.
  • Message and data rates may apply.
  • To stop messages, reply STOP. We may send one final confirmation of your opt-out. To receive help, reply HELP or contact [email protected] or +1 484-673-6679.
  • After opting out, you may opt in again by completing the same consent process you used originally.
  • Wireless carriers are not liable for delayed or undelivered messages.
  • Delivery is subject to the availability and operation of wireless networks and participating carriers.

For information about how OPS handles personal and mobile information, review our Privacy Policy.

6. Acceptable Use

You may not:

  • Use the website unlawfully, fraudulently, or in a manner that infringes the rights of others.
  • Attempt to gain unauthorized access to the website, systems, accounts, or data.
  • Introduce malicious code, interfere with site operation, scrape the site through automated means without permission, or evade security controls.
  • Misrepresent your identity, authority, or relationship with another person or organization.

7. Intellectual Property

The website, branding, text, graphics, processes, and other content are owned by or licensed to OPS and are protected by applicable intellectual property laws. You may view and print website content for your internal business evaluation. No other use, reproduction, modification, distribution, or commercial exploitation is permitted without prior written authorization.

8. Third-Party Services and Links

The website and OPS communications may use or link to third-party platforms and services. Their availability, content, security, and privacy practices are controlled by their respective providers. OPS is not responsible for third-party websites or services that it does not control.

9. No Guarantee of Results

OPS systems are designed to support responsiveness, consistency, and opportunity conversion. Actual outcomes depend on many factors outside OPS control, including inquiry quality, market conditions, customer decisions, client responsiveness, pricing, staffing, service quality, and compliance with recommended processes. We do not guarantee revenue, appointments, sales, response rates, or other particular results.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the website and its content are provided on an "as is" and "as available" basis. OPS disclaims warranties that are not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, availability, and uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, OPS and its officers, members, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from website use. For claims arising solely from use of this free public website, OPS aggregate liability will not exceed one hundred U.S. dollars. These limitations do not apply where prohibited by law or where a signed client agreement provides different terms.

12. Indemnification

You agree to indemnify and hold OPS harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, or information you submit without proper authority, except to the extent caused by OPS's own unlawful conduct.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute concerning these Terms or the website will be brought in a court of competent jurisdiction in Pennsylvania, unless applicable law requires otherwise.

14. Changes and Severability

We may update these Terms by posting a revised version and effective date. Continued use of the website after a revision constitutes acceptance of the updated Terms. If any provision is held unenforceable, the remaining provisions will remain in effect.
